One Nation, One Election: Ex-CJIs Flag CEC Overreach Concerns

Former Chief Justices of India (CJIs) Ranjan Gogoi and Dipak Misra have voiced serious concerns regarding the potential for unchecked power in the hands of the Chief Election Commissioner (CEC) under the proposed “One Nation, One Election” framework. Their apprehensions centre around the CEC’s authority to postpone elections.

In a strongly worded advisory, the esteemed jurists advocated for robust parliamentary oversight of any such decisions. This, they argued, is crucial to maintain democratic accountability and prevent arbitrary delays.

The former CJIs specifically highlighted the need to restrict justifications for election postponements to only matters of grave national security or severe public order disruptions. Any other reasons, they cautioned, could lead to misuse of power.

This timely intervention by two former CJIs underscores the vital need for careful consideration of the potential pitfalls of “One Nation, One Election”. The debate must move beyond mere political expediency and focus on safeguarding the integrity of India’s democratic processes. The nation’s future hinges on a balanced approach that ensures both efficiency and the preservation of fundamental rights.
